Re: Appeal of Unauthorized Parking Fines P-441 through P-443 — Unit 8C / Stall V-7
Dear Directors:
I appeal stacked unauthorized-parking fines P-441, P-442, and P-443 totaling $270 for alleged overnight parking in visitor stall V-7 on July 11–13, 2026. This sample HOA unauthorized parking fine dispute is an educational model of how an owner might challenge guest-permit records, conflicting signage, and bulk ledger charges. It is not legal advice.
My sister requested a visitor permit through the association app on July 10 at 5:18 p.m. and received confirmation number VP-7721 for stall V-7 (Exhibit A). Night photographs taken July 11 at 10:04 p.m. (Exhibit B) show a faded “residents only” plate on the same post as a newer arrow labeled “guest permit parking.” A reasonable guest following the newer arrow would park exactly where the citation occurred.
The owner ledger posted one combined charge labeled “unauthorized parking x3” with no inspector name, no observation time, and no quoted rule for each night. I request that each alleged occurrence be cited separately, with the governing document page attached. A bulk portal charge does not give fair notice of what to cure or how to avoid the next night’s penalty.
The fine letter mentioned a possible towing surcharge but did not enclose the towing addendum or a pre-tow notice. No vehicle was towed. I request the towing contract, any notice the association claims was required, and written confirmation that no removal fee will be added to the account.
I ask the board to (1) dismiss fines P-441 through P-443, (2) confirm that no towing surcharge will be assessed, and (3) replace the conflicting signs at stall V-7 with a single instruction. If, after reviewing VP-7721, the subcommittee finds only a technical stall-code mismatch, I am willing to accept a single warning-level fee instead of three stacked overnight penalties.
Please schedule a hearing, identify any recusals, and provide a written decision. I will attend in person or by the association’s video option and will bring the permit confirmation and stall photographs.
