Re: Dispute of Trash Can Placement Fine No. T-2109 — 41 Laurel Walk
Dear Committee Members:
I dispute Fine No. T-2109, dated July 24, 2026, in the amount of $85, for alleged improper trash-can placement at 41 Laurel Walk. This sample HOA trash can placement dispute letter is an educational illustration of how an owner might contest pickup-day timing, cart-storage language, and notice defects. It is not legal advice.
The citation says carts were “visible from the street after collection.” Rule 6.1 allows carts at the curb on collection day but does not state an hour by which they must be returned to storage. Collection on Laurel Walk routinely occurs after 3:30 p.m. I returned both carts behind the side gate the same evening, before 7:00 p.m. A timestamped photo from 6:52 p.m. is Exhibit A.
The notice did not attach a photograph of the alleged condition, an inspector name, or the recorded declaration subsection. I request the inspection log, any prior warnings at this address, and a copy of the adopted fine schedule. Without that file, a first-instance monetary penalty appears to skip the association’s published courtesy-notice step.
Homes at 37, 39, and 45 Laurel Walk store carts beside side-yard gates that remain visible from the sidewalk. Those lots received reminder emails in July rather than fines. Selective enforcement of a visibility rule is not a fair basis for a first monetary penalty at this address. I ask the committee to compare T-2109 with those recent reminders.
I request dismissal of Fine T-2109, or in the alternative conversion to a written warning and a published retrieval deadline (for example, by 8:00 p.m. on collection day). I will continue to retrieve carts as soon as collection is complete and will store them behind the gate.
Please confirm a hearing date in writing and send any additional evidence at least forty-eight hours before the meeting. I will attend and will bring the collection-day photo and the side-gate storage photo.
