Re: Appeal of Lawn and Landscaping Fine No. L-8841 — 612 Sycamore Trace
Dear Hearing Panel:
I appeal Fine No. L-8841, posted July 18, 2026, for $200 plus $25 per day, alleging “brown lawn and missing foundation plantings” at 612 Sycamore Trace. This sample HOA lawn and landscaping fine appeal letter is an educational model of how an owner might request a hearing, hold daily charges, and document a cure. It is not legal advice and is not a substitute for counsel licensed in your state.
The citation arrived as a portal alert with no certified-mail copy, no photograph, and no quoted subsection of the Declaration or the adopted landscape guidelines. I request the inspector’s file, the current fine schedule, and the specific recorded language relied upon. Until those records are produced, I ask that daily accrual stop and that the association treat this letter as a timely request for a hearing.
From June 20 through July 31, the city of Millbrook limited residential irrigation to two assigned days per week under Stage 2 drought rules. I complied with those limits. On July 7 I signed a written work order with Northfork Turf & Trees (Exhibit A) for sod replacement and two dwarf yaupon hollies. The nursery delayed delivery until August 1 because of heat-related shortages. Installation finished on August 2. Dated photographs from the citation week and from August 2 are Exhibit B.
Landscape Rule 3.2 allows a thirty-day cure after written notice of a first lawn condition. The association skipped that step and posted a monetary fine on day one. I also note that 608, 614, and 620 Sycamore Trace remained brown under the same watering calendar and received courtesy reminders rather than daily penalties. I am not asking the board to ignore covenants. I am asking it to apply the same warning-then-fine sequence used on this street.
I respectfully request that the panel (1) schedule a hearing, (2) waive Fine L-8841 and all daily accrual, (3) confirm in writing that the August 2 work satisfies the landscape standard, and (4) mail any remaining cure instructions to the address on file. I will attend in person and will bring the contractor invoice and irrigation-day calendar.
Please send written confirmation of the hearing date, the exhibits the association intends to introduce, and a hold on further charges pending the decision. Thank you for reviewing this landscaping appeal on the written record.
